Terms of Service

These Terms of Service ("Terms") govern your use of the OG Marka platform operated by OG Marka. By accessing or using our services, you agree to be bound by these Terms.

1. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorised use.

2. Acceptable Use

You agree not to: use the platform for any unlawful purpose; attempt to gain unauthorised access to other accounts or systems; interfere with or disrupt the platform's infrastructure; upload malicious code or content; or resell access to the platform without written permission.

3. Services & Pricing

We offer CRM, ERP, AI agent, and commerce services as described on our website. Prices are listed in INR and are subject to change with 30 days' notice. One-time setup fees are non-refundable once work has commenced. Monthly subscriptions can be cancelled with 30 days' notice.

4. Intellectual Property

The OG Marka platform, including its design, code, and branding, is the intellectual property of OG Marka. You retain ownership of your data. By using our services, you grant us a limited licence to process your data solely for providing the agreed services.

5. Data & Privacy

Your use of the platform is also governed by our Privacy Policy. We implement enterprise-grade security measures including encryption, row-level security, and SOC 2 compliant infrastructure.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our control.

7. Limitation of Liability

To the maximum extent permitted by law, OG Marka shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Termination

Either party may terminate this agreement with 30 days' written notice. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, you may request export of your data within 30 days.

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform. Continued use after changes constitutes acceptance.
